Universal Terms of Service Agreement
This Universal Terms of Service Agreement (“Agreement”) sets forth the general terms and conditions of your use of the Site and the Services. This Hosting Service Agreement (“Service Agreement”) governs your use of 10Corp’s Hosting Services. Capitalized terms used but not defined in this Service Agreement are defined in the Agreement.
1. DESCRIPTION OF SERVICES
1.1 Web Hosting
Web Hosting plans place your site on one or more servers where resources are shared among multiple customers. However, your site is assigned a unique domain name and DNS configuration to direct traffic to its specific hosting environment.
1.2 Business Hosting
Managed Hosting plans provide the benefits of a VPS or Dedicated Server, while 10Corp manages server maintenance, including control panel setup, patching, and backups.
1.3 Managed WordPress Hosting
Managed WordPress Hosting plans provide an optimized environment for WordPress websites. 10Corp handles core administrative tasks, including WordPress installation, automated daily backups, WordPress core updates, and server-level caching.
1.4 Virtual Private Server (“VPS”)
VPS plans place your site on a server shared with other customers while providing full control over your server space and configurations. Users have administrator (root) access and a dedicated IP address.
1.5 Dedicated Server
Dedicated Server plans allocate an entire server exclusively to your account. You have full control over server resources, including bandwidth, memory, and storage, ensuring that performance is not affected by other customers.
1.6 Managed Support
Managed Support plans provide root/administrative access along with Plesk or cPanel. 10Corp manages core patching, security, monitoring, and backups. Additional configurations and installations are available for an extra fee.
1.7 Fully Managed Support
Fully Managed Support plans provide the option to enable root/administrative access while 10Corp handles core patching, security, monitoring, and backups. Additional Expert Services are included in the subscription.
1.8 Hosting Premium Support/Expert Services
Hosting Premium Support/Expert Services (“Expert Services”) provide advanced server administration for a set fee. These services include database optimization, firewall configuration, and content migration assistance.
1.9 Hosting Backup
Hosting backup plans save website files to the cloud once per day. Storage limits apply based on the backup plan purchased. Backup and restore services are included in some hosting plans and available as an add-on for others.
2. ACCOUNT TERMINATION & LIMITATIONS
2.1 Migration of Servers
10Corp may migrate servers as part of standard business operations. Customers with dedicated IP addresses may be reassigned a different IP number, and 10Corp does not guarantee permanent IP allocations.
2.2 Termination of Hosting Services
Upon termination or expiration of your Hosting Services, you must discontinue use of the services and remove content. 10Corp does not provide website transfer services upon cancellation. Failure to move your content before termination will result in permanent deletion.
2.3 Free Product Credits
All free products included with Hosting Services will be revoked upon termination.
2.4 Licensed Images on Migration or Export
Licensed images are for 10Corp-hosted customers only and may be subject to third-party intellectual property rights. If migrating to another provider, it is your responsibility to ensure continued usage rights.
2.5 Storage Capacity & Functionality
Usable storage capacity may differ from advertised limits due to system file requirements. Hosting Backup plans may have storage limitations.
3. YOUR OBLIGATIONS & RESTRICTIONS
3.1 Abusive Activities
You may not use 10Corp servers for mail bombs, denial of service attacks, hacking, or other activities that threaten network stability. Websites causing excessive server loads may be suspended.
3.2 Storage & Security
You are responsible for maintaining independent backups of your data. 10Corp servers should not be used for PCI or HIPAA-compliant environments.
3.3 Website Content Responsibility
Customers are responsible for updating, maintaining, and securing website content. Technical assistance may require modification or removal of hosted files.
4. SERVICE SPECIFIC PROVISIONS
4.1 Web, Business & Managed WordPress Hosting
- Storage & Plan Limits:
- Maximum 250,000 inodes (Linux) or 500,000 files and folders (Windows).
- Maximum 100GB disk storage.
- Database limits: 1,000 tables and 1GB per database.
- Linux hosting limits: 25% CPU core, 512MB RAM, 100 connections, 1MB/s disk IO.
- Exceeding these limits may result in warnings or suspension.
- Website Restrictions:
- Prohibited content includes anonymous image hosting, bulk email scripts, and excessive resource-consuming applications.
4.2 VPS & Dedicated Hosting
- IP Addresses: Customers must use at least 90% of assigned IP addresses within 30 days.
- Backup Services: FTP backup is available for an additional fee.
- Configuration Add-ons: Control panels, external firewalls, and RAID setups require additional provisioning time and may consume server storage.
4.3 Managed SSL
- SSL private keys are securely stored and will not be released to customers.
- SSL certificates must be reinstalled when migrating to non-10Corp servers.
5. SERVICE UPTIME GUARANTEE
10Corp guarantees 99.9% uptime per month. If uptime falls below this threshold, customers may request a 5% service credit. This does not apply to:
- Scheduled maintenance.
- Custom scripts causing downtime.
- External network issues beyond 10Corp’s control.
6. THIRD-PARTY SOFTWARE
- Hosting Services may include third-party software subject to separate licensing agreements.
- Customers must comply with third-party terms when using such software.
- 10Corp is not liable for third-party software failures or damages.
6.1 Additional Terms for Acronis Hosting Backup
- Usage is subject to Acronis’ software license agreement.
- Customers storing protected health information (PHI) must comply with HIPAA regulations.
7. FINAL TERMS
- Customers must ensure their website complies with all applicable laws.
- 10Corp reserves the right to update these terms as necessary.
- Any disputes will be resolved per the jurisdiction outlined in the Universal Terms of Service Agreement.
